These Terms and Conditions ("Terms") govern your access to and use of our website at https://www.truxes.com (the "Site"), powered by Shopify, including any content, functionality, products, and services offered on or through the Site. By accessing or using the Site, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and revising the "Last Updated" date at the top. Your continued use of the Site after such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

To access certain features of the Site, such as placing orders or viewing order history, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.
We reserve the right to refuse or terminate accounts at our discretion.
3. Products and Orders
We specialize in custom signage, including Braille, ADA-compliant, and elevator signs. All product descriptions, images, and prices on the Site are subject to change without notice. We strive for accuracy but do not warrant that product details are error-free.
By placing an order, you agree to pay the listed price, plus any applicable taxes, shipping, and handling fees. Orders are not binding until we accept them, which we may do by confirming via email or processing payment.
We reserve the right to cancel or refuse any order for reasons including but not limited to product availability, pricing errors, or suspicion of fraud. If we cancel an order after payment, we will issue a refund.
As our Site is integrated with Shopify, orders and payments are processed through Shopify's platform. For details on Shopify's terms, please refer to Shopify's Terms of Service.
4. Payments
We accept payments via credit card and other methods as indicated during checkout. All payments are processed securely through Shopify Payments or authorized third-party processors. By providing payment information, you authorize us to charge the applicable amounts.
You represent that you are authorized to use the payment method provided and that the information is accurate. We are not responsible for any overdraft or other fees charged by your financial institution.
5. Shipping and Delivery
We ship products to addresses within the United States and select international locations. Shipping times and costs are estimates and may vary based on location, product, and carrier. We are not responsible for delays due to customs, weather, or other factors beyond our control.
Risk of loss and title for products pass to you upon delivery to the carrier. You are responsible for any import duties, taxes, or fees for international shipments.
6. Returns, Refunds, and Exchanges
We accept returns or exchanges for defective or incorrect products within 30 days of delivery. Custom or personalized items may not be eligible for returns unless defective.
To initiate a return, contact us at sales@truxes.com with your order details. Approved returns must be shipped back at your expense unless the issue is our fault. Refunds will be issued to the original payment method, minus any shipping costs.
We do not guarantee refunds for buyer's remorse or changes in preference.
7. Intellectual Property
All content on the Site, including text, graphics, logos, images, product designs, and software, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission. Use of our trademarks or branding is strictly prohibited without consent.
8. User-Generated Content
If you submit reviews, comments, photos, or other content ("User Content") to the Site, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and distribute such User Content worldwide.
You represent that your User Content does not violate any third-party rights, including copyrights, privacy, or publicity rights, and is not defamatory, obscene, or unlawful.
We may remove or edit User Content at our discretion but are not obligated to monitor it.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE IN QUESTION.

You agree to indemnify, defend, and hold harmless Truxes Company, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.
11. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Kendall County, Illinois.
You agree to submit to the personal jurisdiction of such courts and waive any objections based on venue or inconvenient forum.
12. Force Majeure
We shall not be liable for any failure to perform due to events beyond our reasonable control, including acts of God, war, terrorism, strikes, pandemics, or supply chain disruptions.
13. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any right shall not constitute a waiver.
These Terms constitute the entire agreement between you and us regarding the Site, superseding any prior agreements.
